Welcome to Heard Medical Solutions, doing business as Heard Medical Billing and Coding and HMBCEdu (“Company,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your use of our website, educational content, email marketing communications, and all related services—including training programs, certification exam preparation, and healthcare coding and auditing support (collectively, the “Services”).
By accessing, enrolling in, or using our Services, you agree to comply with and be legally bound by these Terms. If you do not agree, you must not use or access our Services.

3. Paid Services & Enrollment
3.1. Certain Services, including courses, workshops, or exam prep programs, require payment prior to participation.
3.2. Prices and fees are subject to change. Any applicable taxes or processing fees will be added at checkout.
3.3. Refunds or credits are governed by the refund policy specific to each program or event, as displayed at the time of purchase or enrollment.
3.4. Enrollment is not transferable. Sharing access to course materials, recordings, or login credentials is strictly prohibited.

5. Training and Educational Services
5.1. Purpose: Our training programs and certification prep services are designed to educate individuals in medical billing, coding, auditing, and related healthcare administrative practices.
5.2. No Guarantee: Completion of training or prep courses does not guarantee certification, employment, or passing of any professional exam.
5.3. Certification Preparation: Materials provided are based on current industry standards (e.g., AAPC, CMS, AMA CPT, ICD-10-CM) but are not endorsed by any third-party certifying organization.
5.4. Student Conduct: Students are expected to maintain professional behavior and integrity in all learning environments. Disruptive behavior, plagiarism, or misuse of proprietary materials may result in suspension or dismissal.
5.5. Access to Materials: Access to online course materials is time-limited and intended solely for the enrolled student. Unauthorized distribution or reproduction is prohibited.
6. Healthcare Coding, Auditing & Consulting Services
6.1. Scope: The Company provides educational and consulting support for healthcare providers and professionals, including but not limited to documentation review, compliance guidance, audit support, and training.
6.2. Non-Clinical Nature: We do not provide medical, legal, or financial advice. Coding and auditing recommendations are based on standard industry guidelines and payer policies but are not a substitute for professional judgment or compliance oversight.
6.3. Confidentiality: Client data, including protected health information (PHI), will be handled in accordance with HIPAA and Georgia privacy laws.
6.4. Client Responsibility: Clients are responsible for the accuracy and completeness of documentation provided for coding or audit review.
6.5. Limitation: The Company is not responsible for payer denials, revenue losses, or penalties resulting from documentation or billing errors outside our control.
7. Data Privacy & Security
7.1. We respect your privacy and are committed to protecting your personal information.
7.2. We collect limited personal information (such as name, email, and payment details) necessary to provide our Services.
7.3. We do not sell or share your information with third parties except as necessary to process payments or deliver services.
7.4. We implement reasonable technical and organizational safeguards consistent with Georgia data-protection standards and HIPAA where applicable.
8. Intellectual Property Rights
8.1. All materials, including course content, videos, templates, graphics, and other intellectual property, are owned or licensed by the Company and protected under U.S. copyright law.
8.2. You may not reproduce, distribute, modify, or publicly display any part of our content without written authorization.
8.3. You retain ownership of any content or data you upload but grant us a limited, non-exclusive license to use it solely for service delivery and communications.
9. Disclaimer of Warranties

9.2. We make no representation or warranty regarding the accuracy, completeness, or usefulness of course materials or consulting information.
9.3. We do not guarantee uninterrupted or error-free operation of our online platforms or communications.
10. Limitation of Liability
10.1. To the fullest extent permitted by Georgia law, the Company’s total liability for any claim arising under these Terms shall not exceed the total amount paid by you for the specific Service in the preceding 12 months.
10.2. In no event shall the Company be liable for indirect, consequential, incidental, or punitive damages, including loss of income, business, or certification results.
11. Termination and Suspension
11.1. We reserve the right to suspend or terminate access to any Service if you violate these Terms, misuse the platform, or engage in unethical or illegal conduct.
11.2. Upon termination, your access to educational materials and platforms may be revoked immediately without refund.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-law principles. Any disputes shall be handled exclusively in the courts located in Muscogee County, Georgia.
13. Modifications to Terms
We may revise these Terms periodically. Updates will be posted on our website, and the “Effective Date” will be revised accordingly. Continued use of our Services following updates constitutes your acceptance of the new Terms.
